The K-1 Fiancé Visa steps

1. File your petition with the USCIS

The first step is to make sure that you have all the required documentation and supporting evidence for the Petition for Alien Fiancé(e), which you must file with the United States Citizenship and Immigration Service (USCIS).

The K-1 Fiancé Visa – What is it for?

The Fiancé Visa (for simplicity, we’ll use the term as referring to either sex) allows for a foreign citizen to enter the U.S. with the intention of marrying their U.S. partner there, in the next 90 days after their arrival in the country.

It is considered one of the most straightforward paths towards obtaining a Green Card.

The U.S. partner submitting the Petition must:

  • Have no criminal record;
  • Meet the minimum income requirement for his/her state of residence.
The foreign fiancé applying for the K-1 Visa needs to:
  • Reside outside of the US at the time of application;
  • Be legally free and able to marry;
  • Intend to marry their U.S. partner within 90 days after entering the U.S.
